Removal of lesbian mothers’ names from the birth certificate of children has begun in Italy.
The removal is backed by the new legislation passed by the “traditional family-first” government of Prime Minister Giorgia Meloni, which empowered the Italian government to start removing the names of “non-biological gay mothers” from their children’s birth certificates.
In Italy, surrogacy is illegal and gay marriage has not been legalized. As same-sex relationships aren’t recognized in law, the non-biological parent must make a special case for legally adopting their child.
Also, the measure stops men in a same-sex relationship from registering the birth of their child with the two fathers’ names. Instead, they must make one the legal father.
The changed birth certificates affect 33 children of Italian women that underwent artificial insemination abroad and later registered their children under the city’s centre-left government, led by Sergio Giordani, in 2017.
The prosecutor’s office in Padua confirmed that 27 mothers had been removed from 27 birth certificates.
Giordani assumed office under the promise of removing the traditional “mother” and “father” designations on birth certificates, but this was repealed when Meloni’s government directed local authorities to stop registering the children of same-sex parents with both of their names.
Under the new ruling, only the biological parent of a child can be named on a birth certificate.
While introducing the new bill to the parliament in June, Family Minister Eugenia Roccella said: “There is no discrimination against children.”
The aim of the move is to limit certain rights for the non-registered parent and requires them to have approval to carry out everyday family tasks, like picking the child up from school or using public services on their behalf.
In March, the government of Meloni introduced legislation to extend the national ban on surrogacy to couples that use such services abroad. If the legislation is passed, anyone breaking the law could face a two-year jail term and a fine of over $1 million.
